These Terms of Service (“Terms”) govern your access to, and use of the Build Pro Warehouse website (“Site”) and any purchases, services, or transactions conducted through the Site or directly with Build Pro Warehouse (“Company,” “we,” “us,” or “our”).

By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Use of Website

You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the Site or its systems
• Interfere with the Site’s operation or security

We reserve the right to restrict or terminate access to the Site at any time.

2. Products & Pricing

• All products are subject to availability.
• Prices, specifications, and descriptions are subject to change without notice.
• Pricing errors may occur; we reserve the right to correct errors and cancel affected orders.

Quotes provided by Build Pro Warehouse are valid only for the time stated or, if no time is stated, 30 days.

3. Orders & Payment

• Orders are not final until accepted by Build Pro Warehouse.
• Payment terms may vary by customer and may require prepayment, credit approval, or deposits.
• We reserve the right to refuse or cancel any order.

Accepted payment methods may include cash, credit card, ACH, check, or other approved methods.

4. Sales Tax & Tax Exemption

• Sales tax will be charged unless a valid tax exemption certificate is provided prior to purchase.
• Customers claiming exemption are responsible for ensuring compliance with applicable tax laws.
• Build Pro Warehouse may reject incomplete or invalid exemption documentation.

5. Returned Checks (NSF)

If a check is returned unpaid for any reason:

• A returned check fee of up to $30 or 10% of the check amount (whichever is greater) may be assessed, consistent with Ohio law.
• Payment must be made using certified funds.
• Future payments may be restricted at our discretion.

6. Shipping, Delivery & Risk of Loss

• Delivery dates are estimates only and not guaranteed.
• Risk of loss transfers to the customer upon delivery or pickup, unless otherwise agreed in writing.
• Customers are responsible for inspecting materials upon receipt and reporting issues promptly.

7. Returns & Refunds

• Returns may be subject to restocking fees and must be approved in advance.
• Custom, special-order, or cut materials may not be returnable.
• Refunds, if approved, will be issued using the original payment method.

8. Warranties

• Products are subject only to the warranties provided by the manufacturer, if any.
• Build Pro Warehouse disclaims all other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by Ohio law:

• Build Pro Warehouse shall not be liable for indirect, incidental, consequential, or special damages.
• Our total liability shall not exceed the amount paid by the customer for the product or service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Build Pro Warehouse from any claims, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

11. Intellectual Property

All content on the Site, including text, logos, graphics, and images, is the property of Build Pro Warehouse and may not be used without written permission.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
